Table of Contents
For the purposes of these Terms & Conditions, the following definitions shall apply:
1. Order Form – the order form available at www.bemyflowerpoll.sbs, through which the Buyer provides the information required to process an order, including:contact details,delivery address,selected product size and quantity,the email address to which the order confirmation should be sent,and submits the order for processing.
2. Consumer – a natural person, legal entity, or organisational unit without legal personality that has legal capacity and places or intends to place an order through the Online Store.
3. Buyer – a Consumer or Business Customer who places or intends to place an order through the Online Store.
4. Business Customer – a natural person, legal entity, or organisational unit granted legal capacity by law, carrying out business or professional activities in its own name and placing or intending to place an order directly related to those activities.
5. Product – any item offered for sale through the Online Store that may be the subject of an order.
6. Terms & Conditions – this document together with all appendices, policies, and other documents referred to herein.
7. Online Store (also referred to as bemyflowerpoll.sbs) – the online sales platform operated by the Seller and available at www.bemyflowerpoll.sbs, through which Buyers may place orders.

1. Through bemyflowerpoll.sbs, the Seller offers decorative products and fresh flowers for retail sale via electronic means.
2. The Seller reserves the right to modify the range of Products available in the Online Store at any time and without prior notice. This does not affect Products covered by Orders that have already been confirmed by the Seller.
3. The presentation of Products on the Product Pages and within the Online Store does not constitute a binding offer by the Seller within the meaning of the applicable provisions of the Polish Civil Code. An offer is made, and the sales contract is concluded, when the Buyer clicks the "Order & Pay" button, thereby submitting an offer to purchase the selected Products. The contract is concluded upon acceptance of that offer by the Seller.
4. Orders may be placed through bemyflowerpoll.sbs 24 hours a day, 7 days a week.

6. Before using the Online Store, Users are required to read these Terms & Conditions. Reading and accepting these Terms & Conditions is a prerequisite for placing an Order.
7. Nothing in these Terms & Conditions limits or excludes any rights granted to Consumers under the mandatory provisions of the laws applicable in the Republic of Poland.
8. Any agreements concluded through the Online Store shall be governed by the laws of the Republic of Poland.
1. To use the services provided by the Online Store, the Buyer must have access to an IT system that meets the following minimum requirements:
– A computer or other electronic device with access to the Internet.
– A valid email address.
2. For the best experience, we recommend using the latest version of one of the following web browsers:

– Microsoft Edge
– Google Chrome
– Mozilla Firefox
JavaScript and cookies should also be enabled in your browser, as they are required for the proper functioning of the Online Store.
1. To place an Order, the Buyer must complete the Order Form by providing all required information and accept these Terms & Conditions.
2. The Buyer is responsible for providing accurate, complete, and up-to-date information in the Order Form. The Seller shall not be liable for any failure to process or correctly fulfil an Order resulting from inaccurate or incomplete information provided by the Buyer.
3. A sales contract is concluded when the Buyer places an Order and the Seller confirms its acceptance.
If you do not receive an order confirmation email, please first check that the email address provided during checkout was entered correctly. If necessary, please contact us directly so that we can verify and confirm your Order.
Order Process
The ordering and fulfilment process is as follows:
– The Buyer selects a Product by clicking the "Add to Cart" button on the Product Page.
– The Buyer completes the Order Form and accepts these Terms & Conditions.
– The Buyer selects the preferred payment method and delivery option, then places the Order by clicking the "Order & Pay" button.
– The Buyer completes the payment using the selected payment method.
– The Seller verifies the successful receipt of payment and, once confirmed, begins processing the Order.
– The Seller sends an order confirmation and payment confirmation to the Buyer.
– The Seller prepares and dispatches the Order using the delivery method selected by the Buyer and notifies the Buyer accordingly.
4. Orders are processed only after payment has been successfully received by the Seller.
5. If a Product is temporarily unavailable or if the expected fulfilment time is longer than stated on the Product Page, the Seller will notify the Buyer no later than 3 days after the Order has been placed.
In such cases, the Buyer may:
– agree to an extended fulfilment period proposed by the Seller,
– cancel the affected Product, or
– cancel the entire Order.
6. If the Seller is permanently unable to fulfil an Order because the Product is no longer available, the Buyer will be informed no later than 30 days after the Order was placed, and any payments received for the unavailable Product(s) will be refunded in full.
1. All prices displayed in the Online Store and on the Product Pages are gross prices and include VAT, unless otherwise stated.
2. Upon the Buyer's request made during checkout (by selecting the appropriate option in the Order Form), the Seller may issue an invoice. By requesting an electronic invoice, the Buyer authorises the Seller to issue the invoice without the Buyer's signature and agrees to receive it electronically.
3. The prices displayed in the Online Store do not include delivery charges, which are payable by the Buyer. Detailed information about delivery fees and available delivery options is provided during checkout and in the Delivery & Store Pickup section.
4. The Seller reserves the right to change Product prices, introduce new Products, launch, modify, or discontinue promotional campaigns and special offers, and make changes to the assortment available in the Online Store.Such changes do not affect Orders that have already been placed and paid for by the Buyer.
5. During checkout, the Buyer may choose from the following payment methods provided through Stripe:
– BLIK
– Credit or debit card
– Apple Pay
– Google Pay
– PayPal
6. For certain payment methods, an additional processing fee may be charged by the relevant payment service provider in accordance with its own pricing policy. The Seller is not responsible for such fees. Where applicable, the Buyer will be informed of any additional charges before completing the Order.
7. Orders that are not paid within the time limit specified for the selected payment method will be automatically cancelled.
8. For certain Products, the Seller may restrict the availability of specific payment methods. Where this applies, the relevant information will be displayed on the applicable Product Page.
1. Store pickup is available by prior arrangement after placing an Order at one of the following locations:
– Sikorskiego 5H, 53-659 Wrocław
– Buforowa 87U, 52-131 Wrocław
2. Courier Delivery. Orders are delivered by couriers cooperating with the Seller. Where reasonably necessary, the Seller may also use third-party delivery providers such as Glovo, Uber, Bolt, or other transport services.
The estimated delivery time is displayed during checkout. The Seller is not responsible for delays caused by courier or transport companies.
3. Delivery charges are borne by the Buyer and are calculated according to the current delivery price list. The applicable delivery cost is displayed before the Order is placed.
4. Each Product Page includes an estimated order preparation and fulfilment time. This information is provided for guidance only.
5. When the Buyer selects a delivery method, an estimated delivery time is also displayed. Delivery times are based on information provided by the relevant carrier and are indicative only. The Seller is not liable for delays caused by the carrier.
6. If an Order contains Products with different preparation times, the entire Order will be dispatched once all Products are ready, based on the longest stated preparation time.
If partial shipments are agreed with the Buyer, individual Products may be dispatched separately at different times.
7. The Buyer is responsible for accepting delivery of the ordered Product.
8. Upon delivery, the Buyer is advised to inspect the package in the presence of the courier to verify that:
– the contents match the Order; and
– no damage occurred during transportation.
9. If the package has been damaged during transport, the Buyer should prepare a damage report together with the courier and notify the Seller as soon as possible.
Failure to prepare a damage report does not prevent the Buyer from submitting a complaint and does not automatically invalidate any claim. However, it may make it more difficult to demonstrate that the damage occurred before or during delivery and may affect the outcome of the complaint review.
1. Pursuant to Article 27 of the Polish Consumer Rights Act of 30 May 2014, a Consumer has the right to withdraw from a distance contract within 14 days without giving any reason and without incurring any costs, subject to the exceptions set out below.
2. To exercise the right of withdrawal, the Consumer must submit a clear statement of withdrawal from the contract.

3. A model withdrawal form is provided in Appendix No. 2 to the Polish Consumer Rights Act and is also available in §12 of these Terms & Conditions.
4. In accordance with Article 38 of the Polish Consumer Rights Act of 30 May 2014, the right of withdrawal does not apply to:
– Products that are liable to deteriorate rapidly or have a short shelf life, including, in particular, fresh flowers, bouquets, and floral arrangements.
– Products made to the Consumer's specifications or clearly personalised to meet the Consumer's individual requirements.
5. Where the right of withdrawal applies, the Consumer is responsible for returning the Product at their own expense.
The Consumer is liable for any reduction in the value of the Product resulting from handling it beyond what is necessary to establish its nature, characteristics, and functionality.
6. Any payments made by the Consumer will be refunded within 14 days from the date on which the Seller receives the notice of withdrawal.
Refunds will be made using the same payment method used for the original transaction unless the Consumer expressly agrees to an alternative method.
7. The Seller may withhold the refund until the returned Product has been received or until the Consumer provides proof that the Product has been returned, whichever occurs first.
8. If the Consumer selected a delivery method that was more expensive than the least expensive standard delivery option offered by the Seller, the Seller will reimburse delivery costs only up to the cost of the least expensive available delivery method.
1. The Seller shall be liable to Consumers for any lack of conformity or defects in the Products in accordance with the applicable provisions of the Polish Civil Code, taking into account the nature of the Products offered in the Online Store.
2. Where the Buyer is acting as a Business Customer, the Seller's statutory warranty liability for Product defects is excluded to the extent permitted by applicable law.
3. Due to the nature of the Products offered (including fresh flowers, bouquets, and floral arrangements), which are natural and perishable, minor variations in appearance, colour, size, or flower arrangement compared to the photographs displayed in the Online Store shall not be considered Product defects.
4. Complaints relating to Products should be submitted as soon as possible after delivery and no later than 24 hours from the time the Order is delivered.
5. A complaint may be submitted:
– via the complaint form available in the Returns & Complaints section of the Online Store;
– by email to bemyflower.wro@gmail.com; or
– in writing to the Seller's registered address.
6. To help us process your complaint efficiently, we recommend including:
– the Order number or other information identifying the Order;
– a description of the issue;
– photographs of the Product, where possible.
7. The Seller will review the complaint without undue delay and no later than 14 days from the date it is received.
The response will be provided using the same communication method through which the complaint was submitted, unless the Consumer requests another method.
8. If the complaint is accepted, the Seller may, at its discretion:
– replace the Product;
– provide a full or partial refund; or
– offer another mutually agreed form of compensation.
The Seller processes the personal data of Buyers and Users in accordance with the principles set out in the Privacy Policy, available at bemyflowerpoll.sbs.
1. All content available on bemyflowerpoll.sbs, including but not limited to text, photographs, graphics, logos, designs, and other materials, is protected by copyright and other intellectual property laws and is the property of BE MY FLOWER, unless otherwise stated.
Any unauthorised use, reproduction, distribution, modification, or publication of any content from the website without the Seller's prior written consent is prohibited.
The User shall be liable for any damage suffered by the Seller as a result of the unauthorised use of content from bemyflowerpoll.sbs.
2. Any use of the content or individual elements of bemyflowerpoll.sbs without the Seller's express prior written permission constitutes an infringement of the Seller's intellectual property rights and may result in civil and, where applicable, criminal liability under the relevant laws.
1. If any provision of these Terms & Conditions is found to be invalid or unenforceable under applicable law, the remaining provisions shall remain in full force and effect.
2. The Seller does not consent to the use of the contact details provided in these Terms & Conditions, including the email address and telephone number, for any purpose other than placing and fulfilling Orders. In particular, the Seller does not consent to the use of these contact details for direct marketing purposes or for sending unsolicited commercial communications.
3. Any matters not governed by these Terms & Conditions shall be subject to the applicable provisions of the laws of the Republic of Poland, including the Polish Civil Code.
4. The Seller reserves the right to amend these Terms & Conditions by publishing an updated version on the website.
Any amendments shall not affect Orders that have already been placed, paid for, and confirmed before the amended Terms & Conditions take effect, unless the changes result from mandatory provisions of applicable law that also apply to existing Orders.
